I certify that I have read and understand this application and its terms and I execute this document voluntarily and with full knowledge of its significance. I authorize Downs Racing L.P. ( ''DRLP'') doing business as Mohcgan Sun Pocono, to conduct any investigations necessary for the approval of my credit limit. I am aware that this application is required by the regulations of the Pennsylvania Gaming Control Board. I understand that a Counter Check issued by Downs Racing L.P. is identical to a personal check and may be deposited in or presented for payment to my bank or other financial institution. I acknowledge that willfully drawing or passing a credit instrument with the intent to defraud, including knowing there are insufficient funds in my account, is a crime in the Commonwealth of Pennsylvania that may result in criminal prosecution. I am also aware that providing false or misleading statements or omitting information on this application may subject me to civil or criminal penalties.

I am applying for casino credit and/or marker privileges from Downs Racing,L.P. I hereby certify that the information provided in my application is true and accurate and that I have not omitted or concealed material information. I am providing information in this credit application as an inducement to DLRP to grant me credit, to accept my check or marker, and/or to obtain cash, chips or other consideration. I agree that DLRP has the right to reduce or revoke any credit extended to me, and to take action to collect any debt owed by me.

I understand that, if DRLP provides me with chips in exchange for a check, marker, promissory note or other obligation to pay the chips are the equivalent of cash. I agree that a marker or other promise to pay signed by me constitutes a debt to DRLP and may be negotiated by DRLP in the same manner as a check. I understand that if my check, marker or other payment obligation is dishonored by a financial institution because of insufficient funds in the account, because of a stop payment order or for any other reason, I may be exposed to criminal penalties in addition to any civil remedies. I authorize DRLP to collect the costs, interest and attorney's fees incurred in connection with efforts to collect any debt owed by me.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, I HEREBY WAIVE ANY RIGHTS AS I MAY HAVE TO NOTICE AND/OR HEARING PRIOR TO THE EXERCISE BY DRLP OF ANY AND ALL PREJUDGEMENT REMEDIES. I AUTHORIZE DRLP TO APPLY, SUSPEND OR SET-OFF ANY GAMING WINNINGS, JACKPOTS, PRIZES, PLAYER'S CLUB POINTS OR COMPLIMENTARIES EXTENDED TO ME AGAINST ANY DEBTS OWED BY ME, INCLUDING THE COSTS OF COLLECTION THEREOF. I AGREE THAT WHENEVER I HAVE AN OUTSTANDING MARKER, I WILL CONTACT THE CASINO CREDIT DEPARTMENT AT THE CONCLUSION OF EACH TRIP TO MOHEGAN SUN POCONO AND SETTLE OR MAKE ARRANGEMENTS TO SETTLE ALL OUTSTANDING MARKERS AND APPLY ALL WINNINGS TO ANY DEBTS OWED TO DRLP. TO THE BEST OF MY KNOWLEDGE, I AM NOT INSOLVENT OR CONTEMPLATING BANKRUPTCY AND NO SUCH PROCEEDING HAS BEEN INSTITUTED AGAINST ME.

I authorize DRLP to: (a) investigate and to verify the information that I have provided and to conduct such investigations pertaining to the above information as it deems necessary for the approval of my credit limit; (b) review and analyze my credit record; (e) furnish information concerning my credit application to credit reporting agencies and others who may properly receive this information; and (d) take other steps consistent with the investigation and verification of my financial resources and financial responsibility.

NOTICE: Pursuant to the Fair Credit Reporting Act, in the event that we deny credit based in whole or in part on an investigative consumer report about you from a consumer reporting agency, you will be given notice of such adverse action and given an opportunity to obtain a free copy of such report from the consumer reporting agency.
